Secure AI in Fintech 2025: The Compliance Conundrum

Investments in AI among highly regulated companies are skyrocketing. That’s great news for process automation and efficient workflows, but what does it mean for maintaining compliance?

Fintech companies are harnessing AI to manage numerous use cases for improved productivity and cost savings. However, one misstep out of regulatory compliance can cancel all these advancements through fines, penalties, or litigation costs, not to mention stock prices and reputation risks.

The Rise of AI in Financial Services

According to KPMG, the Fintech sector has embraced AI, with investments in AI technology exceeding $12 billion in 2023, reflecting its transformative impact1 .

Let’s look at a publicly traded US Fintech company that provides digital payment processing for substantial transaction volumes. The company exemplifies increasing AI implementation in the financial sector: Its modern tech stack, built on cloud-native architectures and micro-services, uses multiple programming languages and incorporates extensive machine learning capabilities for fraud detection, risk management, and automated customer service. 

However, every step of this company’s rapid AI adoption must contend with stringent existing regulations such as the Fair Credit Reporting Act (FCRA) and the Equal Credit Opportunity Act (ECOA). These laws impose strict requirements on the handling, storing, and sharing of consumer data, ensuring transparency, fairness, and privacy. Financial institutions are also subject to regulations like the Gramm-Leach-Bliley Act (GLBA), which mandates implementing robust data protection measures.

Additionally, the Securities and Exchange Commission (SEC) requires that companies protect material nonpublic information (MNPI) to prevent insider trading or other fraudulent practices. 

Similarly, the Federal Trade Commission (FTC) enforces data security standards to ensure sensitive consumer information is not misused or compromised2. For instance, financial institutions must safeguard customer information under GLBA and notify affected parties in case of breaches. At the same time, the SEC imposes disclosure obligations for any data mishandling that could materially impact investors. As 2025 progresses, it’s not yet clear how well AI integrations in Fintech companies are managing these compliance risks. While the tools these Fintech companies are building are performing, they’re also creating less apparent, mounting challenges in AI adoption that can’t be ignored: 

Talent Shortages 

The adoption of AI technologies presents multiple challenges for financial institutions. Finding qualified AI talent remains difficult, with median salaries for machine learning/AI engineers exceeding $160,000 annually. Despite successful recruitment, organizations struggle to keep pace with rapidly evolving AI capabilities, leading to significant training costs and high turnover rates. Technical teams face the additional burden of managing legacy systems, complex hybrid infrastructure, and poor data governance while implementing new AI solutions, often resulting in compatibility issues and increased technical debt.

Keeping Pace with Emerging AI Threats

Ensuring compliance as AI threats evolve poses another significant hurdle. As AI systems become more sophisticated, ensuring they meet regulatory requirements becomes increasingly challenging while maintaining existing operations. Fintech organizations must navigate data privacy regulations, financial regulations, and AI-specific guidelines while maintaining robust security against emerging AI-related threats for technology that the developers themselves don’t fully understand.

Shadow AI and Policy Bypass

A concerning trend has emerged despite substantial investments in AI governance and training programs. Employees at regulated financial institutions are increasingly circumventing official channels to access AI tools. A recent survey by Software AG indicates that more than 50% of employees admit to using unauthorized AI tools for work-related tasks3. These “shadow AI” practices include:

  • Accessing public AI tools through unblocked websites
  • Disabling corporate VPNs to use restricted services
  • Using personal devices for work-related AI tasks while working remotely
  • Uploading sensitive company data to unauthorized third-party AI platforms

Corporate leadership often maintains a false sense of security, believing that existing policies, mandatory training modules, and traditional cybersecurity appliances adequately prevent the misuse and exploitation of AI. Meanwhile, discussions with low- and mid-level employees who manage the day-to-day operations frequently admit to uploading sensitive information about clients, consumers, or nonpublic corporate data to third-party AI tools because they believe no one will know they personally leaked the information. It saves them time and often increases the quality of their work, so it’s worth it in their mind.  

Most of these employees are correct about the lack of attribution since current cybersecurity and monitoring capabilities fail to effectively identify most AI policy violations. From prior experience and observations of e-learning cybersecurity modules, most people click through the training as fast as possible so their manager doesn’t have to keep reminding them to complete the training. In turn, the employees do not grasp the lessons of the online training that is meant to help protect the company and its customers or consumers.

Severe Consequences of Non-Compliance

The ramifications of unauthorized AI use in regulated industries can be devastating. Financial institutions face fines from multiple regulatory bodies, with penalties potentially reaching millions of dollars per violation. For instance, the SEC imposes hefty fines for mishandling MNPI. At the same time, violations of the GLBA can result in penalties of up to $100,000 per violation for the institution, and individuals in charge can be fined up to $10,000 for each violation. Additionally, FTC enforcement actions for data breaches or non-compliance with privacy rules have led to settlements exceeding $275 million in recent years4.
